報告概要

The relationship between sustainability and intellectual property law is gaining prominence as societies confront urgent environmental challenges. Patents, traditionally seen as instruments to incentivize innovation, are now being re-examined for their potential to support sustainable development. While much scholarship focuses on the pre-grant phase of a patent, relatively little attention has been devoted to the legal enforcement of its rights. This research investigates how sustainability-based arguments can be integrated into patent infringement proceedings by examining how enforcement remedies (injunctions) might be recalibrated to reflect environmental goals and industry realities. Japan is an especially relevant jurisdiction for this enquiry. The Japan Patent Office (JPO) has for years introduced concrete measures to support “green” technologies (including an accelerated examination route for green-technology applications and the Green Transformation Technologies Inventory) and has actively partnered in international initiatives such as WIPO GREEN and IPO GREEN to promote technology diffusion. These institutional features, together with Japan’s Green Growth Strategy and a very large domestic green industry, make Japan an ideal laboratory to study how patent offices and courts can operationalize sustainability goals in practice. Empirically and doctrinally, the project will combine comparative legal analysis between the European Union and Japan, firstly, and between Japan and the United States, secondly, stakeholder interviews, and case studies to develop a practicable enforcement model. The aim is a model that is sensitive to Japan’s institutional innovations and judicial practice, thereby producing recommendations of direct relevance to the JPO, Japanese industry, and international policy debates on harmonizing sustainability-oriented IP enforcement.

（仮訳） 　社会が切迫する環境問題に直面する中で、持続可能性と知的財産法の関係が注目されている。従来、イノベーションを動機付けする手段とみられてきた特許は、今では持続可能な開発を支援する可能性を有するものとして見直されている。多くの研究が特許の付与前の段階に着目する一方で、その権利の法的行使にはそれほど注目されていない。本研究では、環境目標や産業の現実を反映させるためにどのように権利行使の救済措置（差止命令）を再調整できるかを検討することにより、持続可能性に基づく論点を特許侵害訴訟に取り込む方法を調査する。 　日本は本研究にとって特に重要な国の一つである。JPOが「グリーン」技術を支援する具体的な措置を導入してから何年も経過しており（グリーン技術出願の早期審査ルート及びグリーン・トランスフォーメーション技術区分表（GXTI）を含む。）、技術の普及を促すため、WIPO GREENやIPO GREENなどの国際的な取組に積極的に参画している。こうした組織的特性と日本のグリーン成長戦略や大規模な国内グリーン産業により、日本は、実務において特許庁や裁判所が持続可能性目標を実現できる方法を調査するための理想的な研究の場となる。 　実証面及び法理面では、本研究は、先ずはEUと日本、次に日本と米国の比較可能な法的分析において、利害関係者への面接調査、事例研究を組み合わせて、実施可能な権利行使モデルを開発する。日本の組織的なイノベーションと裁判例に敏感なモデルとし、持続可能性を志向した知的財産の権利行使制度の調和に関してJPO、日本の産業、国際政策論争に直接関連のある提言を行うことを目標とする。

略歴

Giorgia GALEOTTA（ジョルジャ・ガレオッタ）氏

ルクセンブルク⼤学法学部博⼠課程において、知的財産法、イノベーション政策及び国際法に関する研究に従事中。
これまでの主な実績：
・ローマ第三大学で政治学・国際関係学を学び学士号取得。
・ロンドンのCenter for Transnational Legal Studies（トランスナショナル法研究センター）の修了証書取得。
・トリノ大学にて欧州法学修士号を最優秀成績で取得。副専攻として「法律とテクノロジー」を修了。
・ハーバード‧ロースクール／WIPO共同のPatentXプログラム修了。
