2025年度招へい研究者 研究成果報告会
知財研では、特許庁委託事業「産業財産権国際課題対策推進事業」の一環として、外国から研究者を招へいし、産業財産権に関する制度調和が必要となる課題について研究する機会を提供しています。このたび、トルコ共和国の研究者が約９か月の招へい期間を終えて帰国する予定です。そこで、研究成果の発表及び参加者との意見交換を行う場を設けるために、研究成果報告会を下記のとおり開催いたしますので、御案内申し上げます。

報告概要
| This research aims to explore the role of patent pools as a regulatory tool for managing AI-related patents and fostering trustworthy AI development in Japan, the United States, and the European Union. With the rapid proliferation of AI technologies, the increasing number of AI-related patents has a significant potential to lead to complex challenges, such as patent thickets and barriers to innovation. Moreover, standardisation in AI has started and will play a key role in ensuring compliance with the emerging laws on AI. Given the pace of patenting AI and standardization in AI, complying with standards will likely require licensing standard essential patents (SEPs). This is where a patent pool comes in, which typically occurs where at least two patent holders reach an agreement on bundling their patent rights related to a specific technology and licensing the rights to use these patents to each other and the third parties. By examining the existing and historical patent pools in three jurisdictions, this study seeks to evaluate their effectiveness in ensuring trustworthy AI, showing regulatory compliance with emerging laws on AI, reducing transaction costs, facilitating technology access, and promoting innovation while addressing anti-competitive concerns. Special emphasis will be placed on understanding how these mechanisms align with Japan’s AI Guidelines for Business Ver1.0, the EU AI Act and the Biden’s Executive Order on AI. The research will involve a comparative analysis of legal frameworks, standardization efforts, and case studies to identify best practices and recommend strategies for integrating patent pools into Japan’s intellectual property system as it related to the AI.（Dr. Kasap is now summarizing his report keeping AI introduction to Autonomous Vehicle and Medical Application in mind.） |
| （仮訳） 本研究は、日本、米国及びEUにおける、AI関連発明を管理し、信頼性の高いAI開発を推進するための規制ツールとしてのパテントプールの役割の検討を目的とする。AI技術の急速な普及に伴ってAI関連発明が増加し、特許の藪（patent thickets）やイノベーションの阻害といった複雑な課題への深刻な懸念が高まっている。さらに、AIの標準化が進んでおり、今後導入されるAI関連法の遵守のために重要な役割を担うと考えられる。AIの権利化と標準化のスピードは速く、標準必須特許（SEP）ライセンスがなければ標準に対応できなくなると見込まれる。ここで、複数の特許権者が合意し、特定の技術に関する各自の特許権をプールし、相互あるいは第三者にライセンスを供与する仕組みであるパテントプールが問題となる。本研究は、三つの国・地域における現在・過去のパテントプールの検討を通じて、競争抑制の課題も念頭に入れつつ、AIの信頼性確保、今後のAI関連法規制の遵守、取引コストの削減、技術アクセスの円滑化、イノベーションの推進におけるパテントプールの有効性を評価する。これらの仕組みと、日本のAI事業者ガイドライン（第1.0版）、EUのAI規制法及びバイデン政権によるAI大統領令との適合性に特に注目する。また、法制度の比較分析、標準化の取り組みと事例の研究を通じて、日本の産業財産制度にAI関連パテントプールを取り込むためのベストプラクティスの探求と戦略の提言を行う。（同氏は自動運転車両や医療へのAI応用を視野に報告を取り纏め中。） |

Atilla KASAP（アティラ・カサップ）氏
イスタンブール弁護士会所属トルコ弁護士
2024年4月まで英国サセックス大学包摂的貿易政策センター（CITP）でポスドク研究員として勤務。サセックス大学では、デジタル化と貿易の法則に焦点を当て、特に規制の収束、データプライバシー、AI、国境を越えたデータフローに対する自由貿易協定の影響を分析。
